State of Florida } This agreement made and entered into this 1st day of
Alachua County } March AD 1893 by and between John Haile, owner of the land
to be hereinafter described party of the first part and F.M. Sanders and W.H. Geiger
of the same State and County party of the second part Witnesseth, that That
the Said party of the first part have granted, leased and farm let to the said
party of the second part the following described land situated in Alachua
County and State of Florida and described as follows to wit: The South East quarter
of Section Twelve (12) Township nine (9) S of Range Sixteen (16) East for the
term of seven months from the date hereof upon the following terms Stipulations
and conditions each of which are to be Strictly binding upon the respective parties
hereto and a failure to comply with any of which shall vitiate and
Annul this contract. The Said land is hereby leased to the said party of the
second part for the sole and exclusive use and purposes of Excavating and
taking therefrom and preparing for Market for their use and benefit
at their own exclusive costs and expense such Phosphate Rock or Phosphatic
deposit as may be situated thereon or therein during the term of this lease
The party of the second part hereby expressly bind himself and agree to pay
to the party of the first part the price and sum of Fifty Cents per Ton for
each and every ton of Phosphate rock or Phosphatic deposit so mined and
excavated. Payments to be made as follows to wit: One Thousand Dollars to be paid
by order from party of second part to party of First Part on H.F. Dutton & Co of
Gainesville Florida which said order H.F. Dutton and Co have this day accepted
This said one Thousand Dollars is an advance payment on Two Thousand
Tons of Phosphatic deposited or Phosphate rock to be mined and excavated from
said land sold to H.F. Dutton & Co by said party of the second part and the
said one Thousand Dollars to be paid by said H.F. Dutton & Co to the party of
the first part, out of the first One Thousand Tons so mined from said land by
the party of the second part and sold to said H.F. Dutton & Co and all Phosphate
or Phosphatic rock outside of and Exclusive of the said Two Thousand Tons
above mentioned to be paid for at the price and sum of Fifty Cents per
ton and payments for the same to be made as soon as the rock is moved
from said land and it is expressly understood and agreed by and between
the parties hereto that the party of the second part shall give at least
five days written notice to the party of the First part or his authorized
agent of such intended removal of any of such rock or deposit taken from
said land and the Party of the first part or his authorized agent shall in
