every instance of the removal or proposed removal of any of such rock or deposit taken from said
land have the right and every facility to inspect weigh or otherwise ascertain the amount of such
rock or deposit and to demand and receive payments therefor at the price above mentioned
upon such removal The weight to be ascertained for the same by weights shown by the
Books of the firm of H.F. Dutton & Co or by the Railroad weights. And it is hereby distinctly
understood by and between the parties hereto that should the party of the second part fail
during the term of this Lease to mine the Two Thousand Tons first above referred to for the
one thousand dollars to be paid by H.F. Dutton & Co to the party of the first part then in that
event the party of the second part shall forfeit the amount of the balance for which he
shall fail to mine rock for the one Thousand Dollars. It is hereby agreed and understood
by and between the parties hereto that if the party of the second part shall fail in any
instance to comply strictly with the terms and stipulations of this contract or any part
thereof such failure on the part of the party of the second part shall work an
immediate forfeiture of this lease and the said land is to be at once delivered up
to the party of the first part. On the First day of October AD 1893 this lease shall
terminate and the party of the second part will on such date Surrender possession
of the said land to the party of the first part. To all of which the said parties of the
first and second part do hereby respectively bind and obligate themselves their heirs
executors and assigns and administrators. In Testimony whereof we have hereunto
