bind themselves and agree to excavate and mine from said
land an average of at least Six Thousand (6000) Tons of
Phosphatic rock or Phosphatic deposit per annum during
each and every year that this Contract shall continue in force
for which they shall pay the parties of the first part the sum
of Fifty cents for each and every ton so mined and excavated
payments therefor to be made in every instance promptly
at the time and times, that the Phosphatic Deposits or
rock taken from said land is moved for shipments from their
storage house to be located at their Phosphatic Works by the
parties of the second part at or near said lands, And it is
hereby expressly provided that before any such rock or de
posits taken from said land shall be shipped any from their
storage house at or near said land, the parties of the sec
ond part shall give at least five (5) days written notice to
the parties of the first or their authorized agent of such in
tended removal and shipment, and the parties of the first
part or their authorized agent shall in every instance of the
shipment or proposed shipment of any of such rock or depos
it taken from said land, have the right and every facility
to inspect Weigh or otherwise ascertain at their own ex
pense the amount of such rock or deposit
Fourth: On the 31st day of December AD of each year during
the Continuance hereof there shall be a settlement in
full by and between the parties hereto for all Phosphatic
rock or deposit taken and shipped from said land during
such year. The parties of the second part then paying
to the party of the first part whatsoever balance may
be due and unpaid for any such year. It being ex
pressly understood that the parties of the second part Shall
take from said land and shall pay for at the rate of Fifty
cents per ton, an average of at least Six Thousand Tons
per annum as aforesaid
Fifth: In the event the general market price of Phosphate
or Phosphatic rock or deposit should decline so low at any
time during the Continuance of this Lease as to render its
shipment so generally unprofitable as to Create a general
Cessation of mining and shipment thereof throughout the
County the parties of the second part in such Case shall have
the right for a period of not longer than one year to
suspend their excavations and mining on said lands and
any such period of suspension under this provision Shall
not be counted as a part of the limited time of this
lease and contract, but on the contrary the parties of the
second part shall be allowed under the provisions hereof
to actively excavate and mine such deposits from such
lands for the full period of five years, but in every
