Your petitioner further showeth that said deceased made a
last Will and testament in which he nominated and
appointed your Petitioner as Sole Executor of all
and singular the goods chattels rights and credits
of said decd.
Your Petitioner herewith presents said paper writing
and prays that the same be allowed and probated
as and for his last will and Testament, and your
Petitioner with ever pray &c

Upon reading and Considering the
foregoing petition and upon an examination had
of the paper writing exhibited; It is ordered that
the same be allowed as and for the last Will
and testament of James B. Abernathy & also that
the said will be admitted to proof

I James B. Abernathy of Nashville Tenn, and now
residing in Hawthorn Florida, do hereby make and
publish this my last will and Testament, hereby
revoking and making void any former wills
by me at any time heretofore made
First; I direct that all my debts be paid as
soon as possible out of the money lying on deposit
to my credit in the Fourth (4th) National Bank
of Nashville. Also I direct that my Executor
shall sell my one-half undivided interest in
the Hawthorn property; that he shall collect
all notes and accounts due me, and the money
collected from the sale of the Hawthorn property
and from the collection of said notes and accounts
to be added to the residue on hand in
the said Fourth National Bank of Nashville, &
all of said money to be disposed of as follows;
one forth of said amount to be given to my
wife Ermine A. Abernathy for her own sustenance |
