4th  It is my will that during the natural life of my wife should any residue
in money remain to my Estate not heretofore disposed of in this my Will
the same to be equally divided year after year between my five children ie
Margaret, Sarah, Rebecca, Isabella and Thomas.
5th  It is my will and desire after the decease of my wife that all of my
personal property then found remaining shall be appraised and divided
equally into five shares between my five children except such as may be
hereinafter otherwise disposed of
6th  After the decease of my beloved wife, I give, will and bequeath to my beloved
daughters, Margaret, Sarah and Isabella my residue and Homestead with
Sixty (60) acres of land attached situated in NE quarter of Section (21) twenty
one Township ten (10) Range (21) Twenty one of the Arredondo Grant in the
Survey of David Burrs & Henry Washington with all the rights tenements or appur-
tenances thereunto belonging with all the household & Kitchen furniture found there-
in. To my daughter Rebecca the improvement where she now lives with twenty (20)
acres of land attached situated in same qr. of sects as described above, the
dividing line between this and the above devise to pass near the North side
of Fort Newnan situated between the two.
To my son Thomas the improvements where he now lives with twenty (20)
acres of land attached situated in south West quarter of the above described sections
7th  The residue of all my Real Estate not otherwise disposed of heretofore I will
and bequeath in trust to my five children ie, Margaret, Sarah Rebecca Isabella
and Thomas and to the heirs of their body after them, each to be trustee for the
other during their natural lives to be held by them jointly equally share and share alike 
subject to their several Will at death and (subject to any just indebtedness they may 
contract subsequent to the Probating of this my Will & Testament to the extent of her 
or his respective interest or share-And it is furthermore my desire and devise that 
no one of my legatees shall have the right to sell or dispose of their interest 
or any part thereof on my Estate to any person outside of my immediate family
without first attaining the consent of all the other legatees with a perfect mutual 
agreement to setting with and bound to the same 
8th  It is my earnest wish and desire that no publick sale of my property, Real or
personal shall ever take place.
9th  I hereby make and constitute my son Thomas B. Kennedy and my daughter
Margaret E. Kennedy, my Executor & Executrix and charge them with the duties
herein enjoined and do not require them to give any Bond or other obligation for the
faithful performance of this trust and they shall never charge nor be allowed my
compensation except for actual expenses and their time in attending to this business
of my said Estate
