To the Hon J.C. Gardner County Judge Coounty Judge of
said County;
Your petitioner Mrs. Francis Doig respectfully showeth
unto your Honor that Mrs. Susan M. Lavey late of said
County departed this life on the 25th day of June
1885 leaving a last Will and Testament, and appointing
Mrs. W.L. Jackson as Executrix of said last
Will and Testament. That Mrs. W.L. Jackson the Executrix
named in said will having refused to act as
such, your petitioner herewith, by an order of this
Court, presents said last Will and Testament for probate
and prays your honor to allow the same to
proof and probate, and your Petitioner will ever
pray &c This July 29th 1885

And now on this day comes Hubert J. Lavey husband
of Mrs. Susan M. Lavey deceased, and ******
the admission to record of Mrs. Susan M. Laveys Will
because he says that;
First;- It is not as the petitioner alleges the last Will
and Testament of Mrs. Susan M. Lavey, because at
the time of the execution of said Will she was not of
a sound and disposing mind and memory.
Second; It is not Susan M. Laveys Will because at
the execution of said paper writing, she was under the
undue influence of William H. Robinson, her father
and others.
Third; That said will presented was legally revoked by
a subsequent Will, and by an oral request that the same
should be destroyed.
Fourth; That said Will was not dictated by Mrs. Susan
M. Lavey nor at her request, but was written and dictated
*** mile and a quarter from the Deceased
and for the purpose at the time as expressed
by said Robinson to depose Hubert J. Lavey from
having any bequest by her will
Fifth; That said Will is not the Will of Susan M.
Lavey because it fails to show that the witnesses |
