Last Will and Testament of W.F. Smith
In the name of God Amen.
I, William F. Smith of Alachua County in the
State of Florida being of sound mind and disposing memory do
make this as my last Will and Testament hereby revoking and annulling
all other Wills and Testaments or Codicils
1 I order and direct that my Executors as soon after my death as
practicable shall pay off and discharge all my debts and liabilities
2 I hereby give and bequeath to my wife Mary A. Smith one
hundred and sixty acres of land situate in said County towit;
the North East quarter of Section Eight in Township Ten Range Fifteen
together with all the improvements therein for her use benefit and
enjoyment as long as she shall remain my widow after her death or
if she should marry again then said land is to revert to my Estate
3 It is my will that the remainder of my Estate shall be Kept to-
gether by my Executors, except the sums of money hereinafter promised
for and shall be managed by my Executors for the benefit of my
heirs. My Executors are authorized to sell off such portions of my
personal property so they may deem not necessary for Keeping together
and managing my Estate and also to sell on such terms as they
may consider best interest of my heirs any portion of real estate
excepting that referred to in the foregoing 2nd item;
4 It is my will that those of my heirs who are of age and have not
received Five Hundred dollars in property or money shall receive
that amount or enough to make that amount in addition to what
they have received from me and that such of my other heirs not of age
shall as each becomes of age shall receive Five Hundred Dollars in
money or other property, provided that if either of said minors shall
marry before he or she becomes of age then he or she shall if my executors
think it proper, receive the said five hundred dollars in money or property
5 It is my will that my said wife shall use and enjoy my household
and Kitchen furniture on the same Terms that she is to enjoy the real
property mentioned in item 2d of this will
6 It is my further will that all my Estate which shall exist at the time
my youngest child shall become of age shall be equally divided among my heirs-
7 It is my further will that any part of my Estate that may hereinafter come to
either of my daughters shall not be sold or in any manner disposed of by their
husbands or be subject to said husbands debts, but this same & the benefit
thereof shall belong to my daughters and the children they may have at their
deaths
8 It is my will that my sons James R. Smith John B. Smith and James
Love my son-in-law he and they are hereby made executors of this will.
The foregoing will was made signed and published by William
F. Smith in our presence on the 16 day of November 1878 & this is signed
by us in the presence of each other on that day. |
