Petition Petition for letters testamentary
To the hon H.G. Mason County Judge of Alachua County
Fla - Your petitioner respectfully showeth unto your
honor that John J. Breeden, late of said County
and State, departed this life on the 5" day of March
AD 1895 leaving goods chattels and credits, to a
small amount, in this County, and heirs and legal
representatives surviving to wit two brothers and one
sister, viz, H.S. Breeden, a brother W.S. Breeden a brother
and Mary M. Earley (nee Breeden) a sister
Your petitioner further showeth that the
said John J. Breeden died testate, having made a
Will before his decease duly and properly signed wit-
nessed and executed, in which said Will the testator
nominated and appointed his said sister Mary M.
Earley to be sole Executrix of his said last Will and
Testament Your petitioner further shows unto your honor
that the said Mary M. Earley declines to act as such
Executrix, and refuses to have anything to do with any
of the matters of said estate and by petition herewith
submitted relinquishes and renounces her right thereto
Wherefore your petitioner herewith submits a paper
writing as the Last Will and Testament of said deceased
and asks to have it duly proved and allowed as the
said Last Will and Testament of the said John J.
Breeden. And prays that Letters of Administration
with the Will, annexed may be granted unto him
the said petitioner, upon the said estate, in accordance
with the requirements of law and the provisions of
said Will, And your petitioner will every pray &c
