1878 is set as the day for hearing testimony in proof of this
execution of said instrument as said last will and testament
of Ann C. Sims deceased and it appearing that
the said B.D. Fry C.E. Boykin and L.B. Micou attesting
witnesses to said instrument **** in this County, It is
further ordered at the request of this petitioner that
a citation issue to B.D. Fry C.E. Boykin and L.B. Micou
attesting witnesses to said instrument requiring them
to be and appear before this Court, on the said 5th day
of June 1878, then and there to testify concerning the
execution of said alleged last will and testament.
And it appearing that said deceased left surviving her
as her heirs and next of kin the following named
parties persons, to-wit; Benjamin Miccou, a resident of this
County and George C. Macou is of full age. It is further
ordered that a notice of this application and the time
above set for hearing the same be given to said George C.
Miccou by publication for three successive weeks in the
"Montgomery Ad**** & Mail" a Newspaper published
in the city and County of Montgomery and State of
Alabama, and by citation duly served upon said
Benjamin Micou at last two days before the day appointed
for hearing requiring them to be and appear
before this Court on said 5th day of June 1878, then
and there to show cause if any, why said petition
should not be granted. It is further ordered that
Benjamin Gardner be and he is hereby appointed
Guardian ad litum for Benjamin Micou, a minor intrusted
in this proceeding, and that he have due notice
of his appointment and the day above appointed for
hearing said petition
