Sims Ann C. deceased
              Last Will and Testament of Ann C. Sims
     I Ann Cresswell Sims being of sound mind and disposing
memory, do hereby make publish and declare this to be
my last will and Testament.
     Item 1st, I will that all my just debts Shall be first paid
by my Executors hereinafter named
     Item 2d   I give and bequeath to my aunt Jane C. Micou
Wife of Benjamin H. Micou all the rest and residue of
my estate of whatever Kind or description whether real
or personal and wherever Situated embracing all *****
in action claims or demands of whatever Kind, including
the claims I am now prosecuting in the State
of New York, against the Executor of the estate of Gazaway
B. Lamar, on my own account and as Administratrix
of the estate of Martha M. Sims.
     Item 3rd  I hereby constitute and appoint Benjamin
H. Micou Executor of this my last Will and Testament
and I particularly direct that he shall not give
any bond for the performance of the duties of said
office; and I hereby invest my said Executor with
full power to sell my real estate of which I may
die seized or to which I may become entitled or my
estate may acquire after my death To collect all claims
due to me, To sell or **promise at his discretion &
in any way he thinks best any claims of any Kind
due to me in any capacity and in fine to do any
and every thing that in his discretion he may believe
to be to the interest of my estate. In Witness whereof
I have hereunto set my hand and seal this fourteenth
(14th) day of April AD 1878

State of Alabama      In the matter of the Probate
Montgomery County     of the last will and testament of
Probate Court         Ann Cresswell Sims decd.
Before me Charles W. Buckley Judge of the said Probate Court
personally appeared in open Court, B.D. Fry who being by
me first duly sworn and examined, did and does depose
and say on oath that he is a subscribing witness to the
instrument of writing now shown to him & which purpose
