                                  {Judge, in and for Alachua
In the matter of the      }       {County, Florida, Sitting
Estate of Louis A. Barnes,}       {Acting and Exercising
Deceased.                 }       {  Probate Jurisdiction.

Petition          To the Hon. H.G. Mason, County Judge
within and for Alachua County, Florida, sitting, acting
and exercising the jurisdiction of a Probate Judge
    The petition of Thomas H. Barnes, a citizen and res-
ident of Boston  Massachusetts, respectfully showeth  unto
your Honor that Louis A. Barnes, late of Gainesville
Alachua County, Florida, departed this life in Gainesville
Alachua County, Florida on the 22" day of March A.D.
1896, leaving a Last Will and Testament which is attached
to this petition, made part hereof and marked Exhibit "A"
   Said last Will and Testament is in due form of
law, and appears to have been witnessed by three
witnesses, to, wit, J.D. Matheson W. Porter & M. Fitch
Miller.  The said last Will and Testament appears
to be genuine, and your petitioner who is familiar
with the handwriting of the deceased, recognizes that
his signature thereto is true and genuine, and verily
believes that the same is the Last Will & Testament
of the said Louis A. Barnes, deceased,
    Your petitioner further showeth unto your Honor
that in and by said Last Will & Testament, the Wife
of the deceased who was living at the time of the
making of said Will, to wit, on the 28" day of May A.D.
1888, was made the sole legatee and devisee under the
said Will of all the property of the said Louis A Barnes
           the Sole
and was made ^ executrix of the said last Will & testament
of said Louis A. Barnes, but that said Sarah B. Barnes
wife of said Louis A. Barnes, departed this life long before
the said Louis A. Barnes died, to. wit. on the -- day of Novem-
ber A.D. 1893. And no other Executor having been appointed
in and by the said Will, It becomes necessary for the
appointment of an Administrator cum testamento
anexo, for the purpose of Administrating upon said
estate
      Your petitioner further show unto your Honor
that the said Will having devised and bequethed
the property of said Louis A. Barnes to Sarah R Barnes
