                                  To the Hon H.G. Mason, County
        Judge, in and for said County and State. The pe-
        tition of T.M. Kirby represents that he is a resident of
        said County and State, and the surviving husband of
        Joanna Kirby, dec'd That the said Joanna Kirby died in
        said County and State on the __ day of __ AD 18-- leaving
        heirs and legal representatives her surviving to wit -
        husband and children, that the said Joanna Kirby
        died testate seized and possessed of an estate of Real
        and personal property And your petitioner herewith
        presents a paper writing which he verily believes
        is the true Last Will and Testament of the said
        deceased and prays that the same may be allowed
        and admitted to probate & Record as and for the said
        Last Will and Testament of the said Joanna Kirby
        deceased, and that Letters Testamentary be issued
        to your petitioner thereon in accordance with the
        laws and the requirements of said Will
        And petitioner will ever pray &c

Proof,                      Before me, H.G. Mason County Judge in
        and for said County & State personally appeared R.W. Jones
        well Known to me, who being duly sworn deposes and says
        that he was present and saw Joanna Kirby sign and seal
        the foregoing instrument and she did declare the same to be
        her Last Will and Testament, and that he together with P.
        B.H. Dudley, and E. Dupree in the presence of the said
        Joanna Kirby and at her request and in the presence
        of each other, signed the same as subscribing witnesses
        thereto
