Proof Personally appeared before me
W.W. Avera, who being duly sworn says that he
was present and saw the Testator James B. Brown
sign and seal the foregoing instrument of writing as
and for his Last Will and Testament and that he
together with Horace Giddings and Geo R. Ellis signed
the same as subscribing witnesses thereto in the presence of
the said Testator and at his and in the presence of each
other, and that the said James B. Brown did then and
there publish and declare the same to be his true Last

The contest of the Probate of the Will }
of J.B. Brown, deceased. }
Order This matter coming on this day to be
heard, and it appearing that the contests of the probate of said Will
have been dismissed and the said Will being produced and duly
proved, it is adjudged that the same be admitted to Probate
which is accordingly done, And it further appearing that H.F.
Dutton, who was appointed in and by said Will the Executor
thereof, is unwilling to qualify as such Executor, and that the said
H.F. Dutton and Mrs Ella D. Brown the widow of the said J.B. Brown
and Mrs Belle S. Stark the daughter of the said J.B. Brown have re-
quested in writing, the Court to appoint G.W. Hyde the present tempo-
rary Administrator of said Estate as the Administrator thereof with the
adjudged and
Will annexed. It is further^ordered that G.W. Hyde be and he is hereby
appointed the Administrator with the Will annexed, of said Estate and
as such Administrator, he shall take charge possession of the assets
real and personal of said Estate and administer the same ac-
cording to law
