I hereby appoint and constitute my wife, Cornelia
           Executrix 
E. Kennedy, and my son Andrew J. Kennedy Executor
when he arrives at lawful age of this Instrument, and
charge them with the faithful performance and did-
charge of the same
          In witness whereof, I, Thomas R. Kennedy
have to this my Last Will and Testament subscribed
my name and set my seal on this 31st day of
August AD 1886

  The foregoing instrument was at the date thereof
signed, sealed, published and declared by the said
Testator, Thomas R. Kennedy, as and for his Last
Will and Testament in the presence of us who at
his request, in his presence and in the presence of
each other have subscribed our names as witnesses

                        Before me personally
appeared W.B. Phifer, who being duly sworn says
he was personally present as a subscribing witness
with C.C. Powell and J.R. Zetrouer who were also
present as two subscribing witnesses and saw the
Testator, Thomas R. Kennedy subscribe his name
to the Instrument of writing hereto annexed as and
for his Last Will and Testament and that the said
Thomas R. Kennedy did then and there in the pres-
ence of the said C.C. Powell, J.R. Zetrouer and affiant
publish and declare the same to be his Last Will
and Testament, That the said three witnesses did
then and there, at the special request of the said
Testator and in his presence and in the presence of
each other subscribe their names thereto as attesting
witnesses. And the said W.B. Phifer further swears
that he verily believes the said Instrument of
writing, hereto annexed, so subscribed, published
declared and attested to be the true Last Will
