Will Samuel Y. Finley
Item 3 equally or as near as practicable in my
property. But if misfortune or necessity
wife
seem to require my said^is hereby authorized
and empowered to relieve the necessities of
any of my said children according to the
promptings of her motherly love being govered
by her own good judgment taking all the cir-
cumstances into Consideration.
Item 4 I hereby nominate, and appoint my said wife
Julia D. Finley sole Executrix of this my last
Will, and Testament, and request that letters Testamen-
tary be issued to her by the proper Probate
Court without requiring her to give or file any
Bond for the due execution of this my last Will
and Testament. I do this because of the perfect,
and absolute confidence I repose in my said
wife.
Commending my wife, and Children to the protecting
care, and everlasting love of God. I hereby on this
the First day of December AD 1898, at Gainesville
Florida sign, and seal this instrument in the presence
of the following witnesses who attest the same at
my request This Dec 1st 1898

State of Florida } Personally appeared before me H.G. Mason
Alachua Co } County Judge for the County aforesaid E.E. Voyle
one of the subscribing witnesses to the foregoing paper writing who being
duly sworn declares and says that S.Y. Finley did in my presence sign
seal, and publish the foregoing paper writing as and for his last Will
and Testament: and that he the said witness, signed the same as a subscri
Witness, at the special request of the said testator: and that the said
testator signed said paper writing in the presence of W.W. Hampton who
likewise signed said paper writing, as subscribing Witnesses in the
presence, and at the request of of said testator and also in the
presence of this affiant, and that he verily believes said paper
writing to be the true last Will and Testament of said testator
