the Executors nominated in the last Will and Testament
of James H. Roper and late of said County, and it appear-
ing that said Will has been duly probated proved
and admitted to Probate in the state of North Carolina
and County of Montgomery;
     It is therefore ordered that the said Will be, and is
hereby admitted to record, and that Letters Testamentary
do issue to the Executors upon their complying with
the Statute in such case made and provided

John T. McKinnon being duly sworn says; That
James Henry Roper late of said County is decd having
first made and published his last Will and Testament,
and that Hon. Isaac Saunders, and Samuel J. Burnett
are the Executors named therein; Further; That the property
of the said James Henry Roper, consisting of Personal
and Real is situate in the State of Florida, and no correct
estimation can be made at the date of this application;
and that J.C. Roper, David I. Roper Nancy
Matheson wife of Samuel Matheson, all of full age
and residing in Montgomery County N.C., are the
parties entitled under the said will to said property
