H. Koehne, Jr of said Newport, or some other suitable person:
is presented to this Court, and it appearing that said petition
was filed in the Office of the Clerk of this Court on the 2nd
day of May, AD 1902 and that the Clerk, on the application
of said Petitioner has given notice in the Newport Dailery
News for fourteen days, once a week at least and such
made of Notice on said Petition being satisfactory, and
further notice on said petition being deemed unnecessary
said instrument is now read, and James F. Marden, one
of the subscribing witnesses is present, and being sworn tes-
tifies that he was present together with Thomas J. Smith
the other witness to said Will who is now dead, and saw
Daniel B. Fitts sign said instrument and heard him
publish and declare the same to be his Last Will and
Testament, and that they at the same time at the re-
quest of the said Daniel B. Fitts, and in his presence and
in the presence of each other, subscribed their names as
witnesses thereto: and that said Daniel B. Fitts was then
of the sane mind and more than twenty one years of age
And no person appearing to object, and the death of
said Daniel B. Fitts being of record: it is thereupon ord-
ered, adjudged and decreed that said instrument is
proved to be the Last Will and Testament of said Dan-
iel B. Fitts, and as such is approved, allowed and ordered
to be recorded, and that Letters of Administration with
the Will annexed, on the estate of said Daniel B. Fitts
be granted to said Charles H. Koehne Jr Henry C.
Stevens, who is named therein as Executor thereof,
having in writing declined said trust. And the said
Charles H. Koehne, Jr is ordered and required before en-
tering upon said trust to give bond in the sum of
One Thousand Dollars, with Samuel R. Honey and
Charles H. Koehne, both of said Newport as sureties
in the form prescribed by law, On the petition of said
Charles H. Koehne Jr in writing, Jeremiah P. Mahoney
Charles W. Crandall and Clarance J. Greason all of
containing a Just
said Newport are appointed to make an inventory^and
Fee 300 appraisement of all the goods, chattels, rights and credits
which were of said Daniel B. Fitts, And is further ordered
that said Charles H. Koehne, Jr give notice of his appoint-
ment with the Will annexed in the Newport Dailey News once a week
for three successive weeks Duncan A. Hazzard
