To the Hon. J.C. Gardner Judge of said court
    The petition of William H. Leas of Desmoins, in the County
of Polk in the State of Iowa, respectfully showeth unto this
Honorable Court that John W. Gustine late of Gainesville in
the County of Alachua in the State of Florida departed this
life at Carroll in the County of Caroll in the State of
Iowa on the 7th day of October 1885 possessed of goods and
estate remaining to be administered, having as his only heirs
at law and next of Kin the persons whose names, residence
and relationship to the deceased are as follows; viz; Mary
A. Gustine and Gustavus C. Gustine his children, and
and Terzah Gustine his sister, that said deceased left a
Last will and Testament and two Codicils each of whom
are herewith presented wherein your Petitioner and Thomas
Roberts and Robert Craig are named as and appointed
therein and thereby as Executors, except in
the last Codicil wherein the name of Robert Craig was
removed and the said Thomas Roberts and your
petitioner were confirmed and appointed as the sole
and only Executors of the said Last Will and Testament
and the Codicils thereto of the said John W.
Gustine deceased, Wherefore your Petitioner prays
that the said Will and the said Codicils may be
proved and allowed and Letters Testamentary granted
to your Petitioner and to the said Thomas Roberts
whenever he shall come forward and duly qualified
by law at Gainesville in Alachua County Florida
in this 28th day of November AD 1885

and the said will having been by me duly examined
