This Indenture made this Twenty Second day of October
1849 between Charles W. Brush and Eugene Van Ness Executors of
the last will and Testament of the late Dr. Nehemiah
Brush of the first part and David Gillet of the County of
Alachua State of Florida, Planter, of the Second part Witnesseth
That whereas Dr. Nehemiah Brush late of the City of New York
now deceased by will bearing date the 11th day of March 1843
and by the Codicil to Said will bearing date the 1st day of
August 1843 appointed Charles W. Brush now of Putnam County
State of Florida, and Eugene Van Ness of the U.S. Army, with
John H. Brush now deceased the Executors of his last will
and Testament as aforesaid, Whereas by the Said last will
and Testament as aforesaid the Said N. Brush authorized
and Empowered his Said Executors or the Survivor or Survivors
of them to Carry by good and Sufficient deeds of Conveyance
any and every part of his real Estate as they might deem
proper and whereas the Said last will and Testament and
Codicil thereto of, the Said Brush was duly admitted to Probate
in the State of New York according to law to Wit On the 3d day
of October 1843, And whereas also Eugene Van Ness by reason of
his profession (and one of the Survivors of the Executors of the Said
N. Brush) is obliged to be absent from the business of the Said
Estate has by his power of attorney bearing date the 1st day of
January 1847 specially and fully empowered the Said Charles
W. Brush his Co-Executor and clothed him with all the
authority the both could have in the Execution of the Said tract
it acting Conjointly Which Said power of Attorney and will &
Codicil are recorded in the Office of the Clerk of the Circuit
Court for county of Alachua And Whereas at a Sale of Land
of the Arredondo Grant at Micanopy on the 24th day of
February 1848, and for several Successive days thereafter Which
Sale was made for the purpose of partitioning the Land
Among the Several owners by allowing them to purchase Such tracts
in Said Grant as they might desire the Said Executors bid in
and had Struck off to them among other Sections, Section
(24) Twenty four Township ten (10) Range Twenty one(21) according
to a Survey made of the Said Grant by Messers Burr &
Washington containing Six hundred and forty Thirty Six
one hundredths Acres of Land (640 36/100)Now Therefore
in consideration of the Sum of One hundred dollars
Lawful Money to us in hand pay by the Said party
of the Second part the receipt of which is hereby
acknowledged with Said parties of the first part
