West 4 chains to a stake thence south 17 chains to a stake thence West 4 chains
to a stake thence North 5 chains to the place of beginning, Except Two acres
heretofore conveyed to Harriet Adams, commencing at a stake a the NE corner of
a 10 acre lot conveyed by Orville Bailey to Garmon, thence running East 14 degrees
140 yards along the Eastern boundary line of said 10 acre tract to a stake, thence
West 70 yards to a stake; thence North 140 yards to a stake thence East 70 yards
to the place of beginning. And also 10 acres heretofore conveyed to Henry Bailey
beginning at a stake at the NE corner of the SW1/4 of section 29 Twp 9 R 20
thence south 1095 feet, thence East 729 feet thence West 210 feet; thence
North 210 feet to the point of beginning leaving as a balance or remainder
to be divided of about seventeen (17) acres, are so situated that a partition
thereof cannot be made without prejudice to the owners, and being satisfied
with said reports and that a division or partition of said lands would not be
for the interest of the owners. Now upon application of the plaintiff it is ordered
adjudged and decreed by the Court that the said lands be sold at public outcry
to the highest bidder by the commissioners before the Court House door, after
giving due and legal notice of the same and the moneys arising from the sale
of said lands shall be paid into the Registry of the court subject to the further
order of the court. It is further ordered that if either of the parties interested
in this suit should desire to purchase any of said land he or she may do
so by paying the amount of the bid less their interest in the same. Upon making
the sale or sales and the receipt and payment of the money and the deposit of
the same into the Registry of the court and before making any conveyance, the
commissioners shall make their report to the Court. The costs of this proceeding
shall be borne equally by the parties to this suit. Also an attorney's fee of
twenty five dollars to be paid complainants solicitor said costs and attorneys
fee to be paid out of the proceeds of the sale of the lands herein.

This cause coming on to be finally heard upon
the complainants Bill and the proof filed herein. It is
adjudged ordered and decreed that the bonds of Matrimony
heretofore existing between J.M. Niece the complainant
Anna Niece the defendant, be and the same are hereby
annulled and dissolved.
