This cause is before me on the motion of defendants
to dissolve the Injunction heretofore granted by the court commissioner
& to dismiss the bill on the Bill answer affidavits & Exhibits - The case
was submitted on the 20th Dec 1898 without argument - The answer
denies the allegations of the Bill & the Exhibits show the deed from
the state to the husband on 22nd Jany 1891 - The Judgment of defendant
Kettlewell against complainants husband was recorded May 8th
Jany 1898, long after Kettlewells Judgment was obtained against
the husband, After the long acquiesence of Complt in the holding of
the title of her husband, I do not think she can now assert it against
the Judgment creditor of the husband (A & E En Law Vol 22 p 55 & note
citing Preston vs McMillan 58 Ala 84) & also Storrs vs Storrs 23rd Fla
274-) It is ordered adjudged & decreed that the Injunction be dissolved
and the Bill be dismissed. Ocala Fla Jany 26th 1899

This cause coming on this day upon application of
Complainant for a final decree and the Court being advised in
the matter and it appearing to the Court from the bill and proofs
herein that complainant is entitled to a decree; it is therefore ordered
adjudged and decreed that the bonds of matrimony heretofore existing
between W.L. Smith the complainant and Eliza A. Smith the respondent
be and the same is hereby dissolved and declared null and void
Done and ordered at Ocala this 24th day of January AD 1899
