                And now on this day comes the complainant by Syd L. Carter and N.M.
Allred his solicitors and it appearing to the court that process was duly served upon the
defendants according to the rules and practice of this court and it further appearing that
on the 7th day of March 1898 a decree pro confesso was regularly taken and entered against
the defendants for want of plea, answer or demurrer; and the cause of action in this
cause of action in this cause being a promissory note secured by mortgage which
promissory note and mortgage are here filed before the Court and read in Evidence
in proof of the amount due complainant from defendants, together with affidavits in
relation to attorney's fees; and thereupon this cause coming on for final hearing upon the
bill the decree pro confesso and the proofs aforesaid, and the Court being fully advised
in the premises doth find; that the Court hath jurisdiction of the subject matter
and the parties to this cause; that the allegations in said bill contained are true
as therein stated and that the Equities of this cause are with the complainant; and
that there is now due from the defendants to the complainant the sum of Two
Hundred and fifty six and 60/100 Dollars for principal and interest on said note and
mortgage and also the further sum of Fifty Dollars as and for Attorney's or
solicitor's fees incurred in and about this foreclosure by complainant, and found by
the court to be a reasonable sum to be allowed. It is therefore ordered adjudged and Decreed
by the court here that the defendants pay to the complainant within three days from this date
the said sum of Two Hundred and fifty six and 60/100 Dollars, with legal interest thereon
from this day until paid, and also the sum of Fifty Dollars as and for Complainants solicitors
fees in this cause incurred and allowed. It is further ordered adjudged and decreed that in
default of said payment being made, as aforesaid by the said defendants then and in that
case the said Mortgaged premises mentioned and described in the bill of complaint, to wit:
The south half of the south East quarter of section twenty three, Township Nine south of
Range fourteen East containing eighty acres of land more or less, be sold at public out cry
for cash in and to the highest and best bidder in front of the Court house door
in said county on some legal sales day hereafter, within the legal hours of sale
and that Robert E. Davis Esq a practicing attorney at the bar of this Court be and
he is hereby appointed as Special Master in Chancery of this Court to execute and
carry into effect this decree; said Master is directed to give notice of the time and
terms of said sale with a description of the premises, in the manner prescribed by
law for sales under execution at law; and the complainant or any of the
parties to this cause may become the purchaser or purchasers at said sale. The
said Master is further directed to pay out the proceeds of said sale, first, his own
costs, disbursements and commissions as allowed by law: second, the fees and costs
of the officers of this Court; third the fee hereby allowed Complainants solicitors;
fourth all unpaid taxes on said premises, and out of the remainder of said
proceeds he shall pay to complainant or to his solicitors of record the said
sum of Two Hundred and fifty six and 60/100 Dollars with interest as herein
decreed and if there be any residue or surplus after making these payments
he shall forthwith bring same into the registry of the Court to abide the
