And now on this day this cause came on to be
heard and the parties Plaintiff and Defendants being in open
Court by their respective Attorneys and the issues being joined a
jury was called and there came L.P. Stroble, C.A. Gassett, W.A.
Strickland, B.P. Boulware J.M. Miller and R.S. Bennett who
were duly empaneled and sworn to well and truly try the issues
joined by the parties in this cause according to the evidence and
the Jury aforesaid after hearing a part of the evidence the further
hearing of this cause was postponed until tomorrow morning at Nine
O'Clock
Whereupon the Court adjourned until tomorrow morning at
Nine O'clock
Thursday May 12th 1898
The Court met pursuant to adjournment of yesterday his Hon
W.A. Hocker Judge presiding

And now this cause came on to be further heard
and the parties plaintiff and defendant being in open Court by their
respective Attorneys as also the jury who had been duly empaneled and
sworn herein, to wit: L.P. Stroble, C.A. Gassett, W.A. Strickland
B.P. Boulware, J.M. Miller and R.S. Bennett the hearing of this cause
was resumed, and the jury aforesaid after hearing the balance of the
evidence the argument of Counsel and the the charge of the Court retired
to consider of their verdict and after due consideration thereof
they returned into open Court and rendered the following verdict to wit
We, the Jury find that the plaintiffs J. Cummer and Wellington W.
Cummer, of and constituting the firm of J. Cummer & Son, for the use
