                Friday May 13th 1898
to withdraw the case from the jury, to continue the case and to be
allowed to amend so as to make additional parties defendant and
now said motion having been submitted to the Court and ar-
gument had thereon, and the Court being advised in the premises
doth decide and order that the said motion be and the same
is hereby granted, thereupon a juror was withdrawn, the jury dis-
charged and the case remanded to the rules for amendment by
making other parties defendant. To which ruling and order of
the Court the defendant excepts.

Whereupon the Grand Jury came into open Court and made
the following report,

                  And now comes the Appellee in the above styled
cause by his attorney B.A. Thrasher his attorney and moves the
Court for an order dismissing the appeal in the above stated
cause, and now said motion having been submitted to the court
and argument had thereon and the Court being advised in the
premises doth decide and order that said motion be and the
same is hereby denied
