Whereupon the Clerk issued the venire as by the Court directed.

                   The above styled cause having been set for trial on
the 20th day of May 1898, and it appearing to the presiding Judge
to be necessary to have a special venire from which to select a jury to
try said case, the Judge of the Court in the presence of the Clerk and
sheriff of said County, drew from the box containing the names of
persons slected for jurors for the year 1898 the following named

The Clerk will issue venire for the foregoing jurors, returnable

                       Now comes the defendant in the above stated
cause by his Attorneys Evans Haile and Horatio Davis Esqrs
and moves the court to set aside the verdict of the jury rendered
herein in said cause and to grant him a new trial and now said
motion having been submitted to the Court and argued by Counsel
for both parties and the Court being advised in the premises
doth decide and order that said be and the same is hereby
