Gus Reid }
Now comes the defendant by his attorneys and
moves the Court to quash and dismiss the indictment in the above
cause and now said motion having been submitted to the Court
and argued by Counsel for both parties and the court being ad-
vised in the premises doth decide and order that said motion
be denied. To which ruling and order of the Court the defendant
by his Attorneys then and there excepted.

Upon joint request of the parties in the above
stated cause the Court appointed N.M. Allred as stenographer
to take testimony in said cause, who was duly sworn as such
stenographer by the Clerk of this Court.

And now on this day this cause came on to be heard
Syd L. Carter State Attorney prosecuting in the name and by
the authority of the State of Florida and the prisoner Gus Reid
being now in Open Court in his proper person as well as by his
attorneys Robert E. Davis and J.M. Rivers Esqrs, and now the
prisoner being brought to the bar herein under the custody of
L.W. Fennell sheriff of Alachua County to which sheriff
he is likewise committed was demanded how he would acquit
himself of the charge against him saith that he is not guilty
of the charge as alleged in the indictment against him and
for good and evil puts himself upon God and the Country
for trial, Whereupon a jury was called and there came J.F.
Townsend, Geo B. Evans J.P. Jones W.D. Cauthen A.J. DaCosta
J.W. Riggs D.A. Robertson G.T. Kennard R.J. Lane,
Geo B. Cellon Maxey Bennett and Geo Gleason who were
duly empaneled and sworn to well and truly try and true
deliverance make between the State of Florida and the
bar
prisoner at the ^ whom you shall have in charge according
to the evidence and the jury aforesaid after hearing the evidence
the argument of Counsel and the charge of the Court retired to con-
sider of their verdict. #
Whereupon Court adjourned until tomorrow morning at Nine O'clock.

# Whereupon for good and sufficient
cause shown the Court excused C.Y.
Crawford, J.O. Andrews & B.J. Earle
three of the Jurors summoned on the regular
panel of the jury for the second week of this
term from further attendance upon the Court.
