                Spring Term AD 1898
                 Friday May 20th 1898
heard and Syd L. Carter State Attorney prosecuting in the name and
by the authority of the State of Florida and the prisoner Wm C. Summers
being now in open Court in his proper person as well as by his Attorneys
Evans Haile, B.A. Thrasher and S.Y. Finley Esqrs and now the prisoner
William C. Summers being brought to the bar herein under the custody
of L.W. Fennell Sheriff of Alachua County to which sheriff he is
likewise committed was demanded how he would acquit himself
of the charge against him saith that he not guilty of the charge as
alleged in the indictment herein against him and for good and
evil puts himself upon God and the Country for trial.
Whereupon a jury was called and there came C.N. Merry J.F. Town-
send James T. Collins L. Klein G.M. Sharp G.W. Davis T.M. Grif-
fin A.J. Ennis John Dyess A.J. Bates L.C. Doane and J.G. Beville
who were duly empaneled and sworn to well and truly try and true
deliverance make between the State of Florida and the prisoner at
the bar whom you shall have in charge according to the evidence
and the jury aforesaid after hearing a portion of the evidence,
Whereupon the Court adjourned until tomorrow morning at
Nine O'clock


               Saturday May 21st 1898

The Court met pursuant to adjournment of yesterday his
Honor W.A Hocker Judge presiding.

William C. Summers }      Evans Hail B.A. Thrasher S.Y. Finely
               And now this cause came on to be further
heard Syd L. Carter State attorney prosecuting in the name and by
the authority of the state of Florida and the prisoner Wm C. Summers
who had been arraigned herein on yesterday and pleaded not guilty
being now in open court in his proper person as well as by his
attorneys Evans Haile B.A. Thrasher and S.Y. Finely Esqrs and also
the Jury who had heard a portion of the evidence in this cause on
yesterday, to wit: C.N. Merry, J.F. Townsend James T. Collins L. Klein
G.M. Sharp G.W. Davis T.M. Griffin A.J. Ennis John Dyess
A.J. Bates L.C. Doane and J.G. Beville being likewise in Open
Court the hearing of this cause was resumed and the jury afore-
said after hearing the evidence and the charge of the Court retired to
consider of their verdict and after due consideration thereof they
returned into open Court and rendered the following verdict to wit:
We the Jury find the defendant William C. Summers not
