Whereupon the defendant was discharged from custody,
and the Court adjourned until Monday morning next at

his Honor W.A. Hocker Judge presiding.

Edward Wideman } Motion to set aside verdict and for a new trial
And come the defendants by their attorneys Evans
Haile and B.A. Thrasher and move the Court to set aside the verdict
rendered herein in the above stated cause and for a new trial and now
said motion being submitted to the Court and argued by both parties
and the Court being advised in the premises doth decide and order
that said motion as to Hall Mitchell be overruled and that said
motion as to Edward Wideman be granted.
Whereupon on motion of the State Attorney a nol pros was entered
as to Edward Wideman one of the defendants, who was discharged
from custody.

And now the prisoner Hall Michell being in open
Court for sentence was demanded if he had anything to say why
the sentence of the law should not be passed upon him saith
nothing whereupon the Court sentenced the prisoner in manner
and form as follows, to wit:
The Sentence of the law is that you Hall
Mitchell do pay a fine of Twenty Five Dollars and one half of the
court costs and the state attorney's fee and in default of the payment
or or giving bond for same within thirty days, that you be confined in the
county Jail at hard labor for six months.
