                   This cause came on to be heard and was
argued and submitted by Counsel for the respective parties hereto.
And the Court being advised in the premises thereupon, upon con-
sideration hereof, it is ordered and adjudged that the first assign-
ment of error is well taken and that the order made on the 22nd
day of April, A.D. 1896 by the County Judge opening up and setting
aside the default judgment made and entered up on the 18th day
of April A.D. 1896 should be re-instated.
It is further ordered that the 3rd, 4th, 5th and 6th assignments
of Error are well taken.
It is therefore considered, ordered and adjudged that the final
judgment rendered in this cause by the County Court of Alachua
County Florida, on the 17th day of October, AD 1896, and the
order of the County Judge made and rendered on the 22nd day of
April A.D. 1896, opening up and setting aside the default judgment
rendered on the 18th day of April, 1896 by the said County Judge
of Alachua County Florida be and are hereby reversed and set
aside and the cause remanded to the County Court of Alachua
County Florida for such other and further proceedings herein as
may be proper and in conformity to this decision.
 It is further ordered that the defendant in Error do pay the costs
incurred in this cause and that execution do issue hereon therefor,
as provided by law in such cases.
