John George Angerman } Final Decree
This cause coming on on this day upon application of complainants
solicitor to be heard for a final decree herein upon consideration thereof and it
appearing to the Court that there is due to the complainant on his debt secured
by the mortgages filed as exhibits in this cause the sum of Two thousand three hundred
seventy three 69/100 dollars; it adjudged ordered and decreed that unless the said John
George Angerman within ten days from this date pay the said debt with the costs
of this proceeding Master's fee of $4 08/100 together with an attorneys fee for one hundred
fifty dollars to complainants solicitor it appearing to the Court from evidence
before it that said fee is reasonable and proper, that the mortgaged premises
described in the bill of Complaint in this cause to wit: Lots numbers one (1) and
Twenty five of the Mackey and Hudson Tracts according to the Recorded Plat
thereof the same being Recorded in Book "J" of the Public Records of said County
at page 906 comprising Eighty acres more or less be sold public auction for cash at
the door of the Court house of said Alachua County Florida to pay the same; that
notice of the time and place of sale be published for thirty day in the Gainesville
sum a newspaper published in the City of Gainesville Alachua County Florida;
That R.E. Davis Esq is hereby appointed a Special Master to Execute this decree
that that said Master execute a deed to the purchaser of said mortgaged premises on
said sale; that out of the proceeds of said sale he pay the costs of this suit retain for
his services the fees allowed him by law for said services, pay to complain Solicitor
the sun one hundred fifty dollars as Attorney's fees and the balance of the
purchase money pay to the Complainant in payment as far as it will go of
the amount due him, should there be any overplus money arising from sale
after payments above directed said Master should bring the same into Court
to abide the further order thereof. It is further ordered, adjudged and decreed
that should said sale take place the defendants in this cause and all persons claiming by
through or under him be forever barred and foreclosed of and from all equity of redemption
and claim of in, and to said mortgaged premises.
