                   Order Dismissing Suit etc
 This cause coming on to be heard and the defendant moving to dismiss said suit
under section 1686 of the Revised Statutes of the State of Florida, because the plaintiff has
neglected to give the notice required by the statute for more than sixty days after the
issuing of the writ of garnishment herein, and it appearing from the certificate of
the Clerk of this Court that no such Notice has been filed in his office and no
evidence of any notice being produced by plaintiff, and the Court being advised in the
premises, thereupon, upon consideration hereof it is ordered and adjudged that this suit
be and the same same is hereby dismissed at the cost of the plaintiff and that upon
the failure of said plaintiff to pay the costs that execution do issue herein for the same
to be taxed up by the Clerk of this Court. And it is further ordered that the writ of
Garnishment issued herein be and the same is hereby quashed and James M. Graham
Garnishee is hereby discharged from all other and further liability by reason of the writ
of Garnishment issued in this cause.

               It appearing to the Court that the defendant in the above entitled
by his solicitor has filed his praecipe in the Clerks office of the Circuit Court of
Alachua County withdrawing his petition for a rehearing of argument upon the
upon the demurrer in said cause - the said demurrer of the said defendant
having been heard and determined on the 11th day of April AD 1898 - and in
said praecipe has directed the Clerk of said circuit court to strike from the
record in said cause the record of filing of said petition on motion of Complainant
by her solicitor it is adjudged ordered and decreed that said filing of
petition and said petition be stricken from said cause, and it is further
ordered and adjudged that the Clerk of said Circuit Enter a decree pro confesso
against the said defendant and upon the Entry of such decree that E.E.
who is hereby appointed a Special Master for the purpose shall take the
testimony for Complainant in said cause and report the same to the Court
