due on date of report 8th December 1897 ($779.95) seven hundred and
seventy nine & 95/100 dollars the said exception is overruled and denied
2nd That the 2nd, 4th, 5th & 6th exceptions to said report are hereby overruled.
It further appearing to the Court from the pleadings and the evidence
that the first deed made by T.B. Ellis to E.W. L'Engle dated December 14th
1876 conveyed to said E.W. L'Engle only a life Estate in the lands therein
described and had no seal and that on 28th day of June 1884 the said T.B. Ellis
the mortgagor made a deed of correction and reformation to the said E.W. L'Engle
and that this latter deed was made after the release made by complainant (Mortgagee)
to said Ellis the Court is of opinion that this deed cannot relate back and
defeat the lien of the complainants mortgage and that the Equities in this cause
are with the complainant, and so decree, The Court further decrees that the
lands set forth in complainants Bill are subject to the lien of the mortgage
herein, and the complainants solicitor is directed to prepare a final
decree of foreclosure not inconsistent with this order and submit to the Court
for entry.

Thomas B. Ellis, Fannie W. L'Engle as Executrix     }
of the last will and testament of Edward M. L'Engle }
deceased, and Mary V. Hunt and A.R. Hunt, her       }
husband                                             } Decree of Foreclosure
        This cause coming on to be further heard and the Court being
advised in the premises, thereupon upon consideration hereof, it is ordered
adjudged and decreed as follows to wit:
1st That there was due and owing by the defendant Thomas B. Ellis, to the
complainant, upon the mortgage and note sued upon hearing, on the date of
the filing of the report and findings of J.A. Ammons as Special Master
herein to wit: on the 8th day of December AD 1897 the sum of $779.95 for
principal and interest and the further sum of $15.00 allowed to the
master for taking testimony on making an accounting and reporting
herein, and that the said defendant Thomas E. Ellis do pay the same,
together with lawful interest thereon from the 8th day of December 1897,
together with costs of this suit to be taxed up by the Clerk of this Court, to
the complainant, or his attorneys within ten (10) days from date of this
decree
2nd That in default of the payment of this decree fees and costs by
