35.00 dollars, hereby allowed for Solicitors' fees, in said cause to the
complainant, or his solicitor of Record, and also the costs of the Court,
in this suit, to be taxed by the Clerk of said court. That in default of said
payment being made, as aforesaid by the defendant, then that in
that case, said mortgaged premises mentioned in the bill of complaint in
this cause, being that certain piece, parcel or tract of land, situated,
lying and being in Alachua County, State of Florida, described as follows
to wit: Lot Five (5) of Block Twenty six (26) in the town of Fairmount, now
known as High Springs, according to the recorded plat thereof, on file
and of record in Plat Book "A" at page #6 at the court House, in Gainesville
Florida, to be sold at public action by the Special Master herein, named
by the Court, after due and legal notice of the place for its sale, as
required by law; and said Special Master is directed to execute and
deliver to the purchaser or purchasers of the said property a good and
sufficient deed, for same, and that he do put said purchaser into possession
thereof; that said Special Master, out of the proceeds of said sale shall
retain his fee and commission on said sale; that he pay the officers of
the Court their costs in this suit, and that out of the remainder
of said proceeds, he pay to complainant, or his solicitor of record
the sum of $925 75/100 dollars for principal and interest; and that
he pay to complainant's solicitor the sum of $35.00 Dollars as
solicitor's fee; In the event that said property shall sell for more than
will pay this decree, expenses and costs, then the surplus, shall by
said Master, be paid to defendant herein.
It is further ordered, adjudged and decreed, that the defendant and
all persons claiming, by, through, or under him be forever debarred and
foreclosed of and from all equity of redemption, in and to said described
mortgaged premises, or any part thereof:
It is further ordered that H.G. Mason Esq a practicing attorney at
law be, and he is hereby appointed Special Master in Chancery
to make the said sale of the said mortgaged premises and to carry
out the provisions of this decree
