bill and has been submitted. I am of opinion that the demurrer is not
well taken - & it is therefore ordered adjudged & decreed that the said
demurrer be and same is hereby overruled and defendant, required to plead or
answer on or before the 15th Sept 1898

This cause coming on to be heard before the Judge of the Third
Judicial Circuit of Florida, it appearing by affidavit of Counsel for
defendant, that the Judge of the Fifth Judicial Circuit of Florida is absent
from the State of Florida and the defendant by his solicitors having set
down the said cause for final hearing upon the bills answers and
replications and the same having been submitted and the Court being
advised in the premises, thereupon upon consideration hereof, it is ordered
adjudged and decreed that the complainants original and amended
bills of complaint be and the same are herein and hereby
dismissed and the relief prayed for denied;
And it is further ordered and decreed that the complainants do pay
the costs of this suit to be taxed up by the Clerk of this Court,
and that Execution do issue for said costs against said complainants
upon application of defendant or his attorneys
