This Indenture made theto first day of April in the year of our
Lord One thousand eight hundred and fifty two between George M. Payne
George R. Fairbanks and William A. Forward Commissioners appointed
by the Circuit Court of the Eastern Circuit of Florida setting as a Court
of Chancery, by orders or decrees made and entered at the City of St
Augustine in and for the County of St. Johns, in a certain case in Par-
tition depending in said Court wherein John W. Brush and others
are complainants and Mose E. Levy and others are defendants of
the first part and Henry G. Marguard of the second part
Withesseth; that whereas at sale of Public Auction of certain Land
of the Arredonda Tract or Grant, advertised and held by the Com-
missioners appointed in said cause ( in pursuance of an order or
decree of said Court, made and entered in St. Augustine on the
thirteenth day of November AD 1848) at Micanopy on the said Arre-
donda Grant, the 21st day of Febuary AD 1849, the following

described Lots or parcels of land, situate lying and being^the County
of Alachua, in said State of Florida, were struck off to, and
bid in by John Beard, he being the highest bidder therefore, to wit,
Section No 19 in Township No 9 of Range No 22 containing Five hun-
dred and sixty four acres, Section No 24 in Township No 10 in Range
19 containing 640 acres, Section No 31 in Township No 10 in Range
19 containing 627 88/100 acres, Section No 32 in Township No 10 Range 19
containing 628 60/100 acres, Section No 1 in Township No Eleven Range
18 containing 640 92/100 acres, Section No 6 in Township No 11 in Range 19
containing 646 24/100 acres, Section No 35 in Township No 9 in Range
18 containing 640 acres as laid down on the Map of the said Arre-
donda Grant made on the 9th February in the year of our Lord 1846
by Messrs Burr, Washington and Merry Commissioners appointed by
the said Court at the June Term of 1845; as by reference thereto
will more fully appear. And whereas the said Commissioners report-
ed the said sale to the said Court, and the said Court by decree
made and entered on the 11th of August AD 1849, approved of the
same and confirmed said report. And whereas the said John
Beard has faithfully and truly performed all the orders, terms,
stipulations, and conditions which were by order or dedree of said Court
on his part to be performed: and whereas the said Court has direc-
ted the said parties of the first part Commissioners as aforesaid
to execute to the said John Beard this deed thereof, and the said
said John Beard having assigned and conveyed the same to the
said party of the second part, and requested that the said parties
of the first part as Commissioners as aforesaid should make this
deed to the party of the second part.
Now therefore Know ye that we the said parties of the
first part by virtue of the authoriy vested in us as aforesaid,
and in consideration as aforesaid have granted, bargained
and sold and by these presents do grant, bargain and sell unto
the said Henry G. Marquand and his heirs and assigns for-
ever, the said above described tracts of land and each and every
of them with the appurtenances of each and every of them, and
all the estate, Right, Title, and Interest which the Parties to the
said cause in partition, and each and every of them had on
the said Twenty first day of Febuary aforesaid or at any time
since or now hath To Have and To Hold
