This Indenture made this twenty Eight Day of June in the year of
our Lord One Thousand Eight hundred and fifty three between Charles A.M.
Mitchel, Special Master in Chancery, residing in Ocala, Marion County State
of Florida, of the first part, and Benjamin A. Putnam of St Johns County
State aforesaid, of second part. Whereas, at the November Term in the
Year Eighteen hundred and forty nine, of the Circuit Court of the Eastern
Circuit of the State aforesaid, Setting in the County of St Johns, it was a-
mong other things ordered, adjudged, decreed, by the said Court, in a cause
then depending in Chancery between Peter Benet Administrator of Francis
P. Sanches Decd, for the use of Aaron Friedlander, for himself and others
and Benjamine A. Putnam, Executor of Peter Mitchel Peter Mitchel Decd,
and Administrator of Robt Mitchel and Samuel G.L. Moore Decd that the
said party of the first part, should be appointed Special Master in
Chancery in the said cause: and that among other things in the said
decree Specified, the said Special Master should be authorized and em-
powered to sell the estate of the said Peter Mitchel decd or so much
thereof as may be saleable, included in the tract known as the Arredondo
Grant. Said sale, and all other sales in the said Decree, contemplated to
be made at some convenient point within said grant, and after notice
of such sale to be given by said Master, in some Newspaper published
in Florida, and elsewhere, if said Master shall not deem such notice
elsewhere inexpedient and unnecessary for a period of not less than sixty
days, and whereas, afterwards at the June Term of One thousand
Eight and fifty of the said Court it was further ordered, adjudged
and decreed in the said cause that the said decree, appointing the said
party of the first part Special Master as aforsaid Should be so
modfied and altered as to authorize and empower the said Master to sell
my part of the said Real Estate mentioned in said first decree at private
sale for cash, or on reasonable credit, provided that no part of said Real
Estate shall be sold at less price than that for which it was purchased
in by the said defendent Bengamin A. Putnam, as Executor as aforesaid
at the sale made of lands of the Arrodonda Grant in the month of
February , One thousand Eight hundred and forty nine and no sale by
the said Master shall be held binding and or valid until the same shall have
been reported by the said Master to the said Court or to the Judge thereof
and been confirmed. Whereas by a decree of the said Circut Court for
the Eastern Circuit District of Florida made on Friday November 5th
A.D. 1852 it was among other things ordered adjudged and decreed, that
the Lands in the Arredonda grant, belonging to the estate of Peter Mitchel
deceased, and remaining unsold, should be sold by the Special Master
appointed in the above Entitled Cause at Public Auction at Micanopy, after
giving three months notice of said sale , in the Conservator published at Ocala
and the Florida News published at Jacksonville, and whereas in the said
Decree it was further ordered, adjudged and decreed that the said sale
should be made upon the following Terms. To bid, one third of the pur-
chase money in cash down, and the remaining two thirds in two equal
annual installments with interest at six percent and whereas at a sale
of said Lands made in persuance of said decree at Micanopy on the 25th
day of March A.D. 1853, the said Benjamin A. Putnam became a pur-
chaser at the highest bider for Section Thirty one (31) Township Ten
(10) Range Twenty (20) And whereas, to the said party hath this day com-
plied with and fulfilled the said Contract, and paid the whole
amount of his purchase money therefore, Now this indenture Witnesseth
