premises and that I have full right and power to sell and covey the
same that the said premises are free and clear of all encumbrances And
I the said Samuel W. Burnette will warrant and for ever defend
the right and title of the aboved described premises unto the Said
Elijah Barrow his heirs and assigns against the claim or claims
of all persons Claiming by through or under me and against the
claims of all persons whatsoever Provided nevertheless and these
presents are upon this express consideration whereas the said Samuel
W. Burnette his this day made and executed to the said Elijah
Barrow two certain promissory notes bearing even dates with these
presents one of said notes being for the sum ninety four dollars
and seventy two cents and payable one day after date to the
said Elijah Barrow or bearer and the other of said notes being
for the sum ninety four dollars and seventy two cents payable on or
before the first day of January next to the said Elijah Barrow
or bearer, Now if the said Samuel W. Burnette shall pay or
cause to be paid to the said Elijah Barrow his heirs and assigns
the amounts of said notes when the same become due and pay
able according to tenor and effect thereof then and in case the
Estate hereby granted and this indenture shall cease determine
and be of no effect In witness whereof I the said Samuel
W. Burnette have this day set my hand and seal this 21st day
of October A.D. 1853
