and altered as to authorize and empower the said Master to sell any part of
the said real Estate mentioned in said first decree at private sale, for
cash, or on reasonablbe credit, provided that no part of the said real estate shall be
Sold at a less price than that for which it was purchased in by the said Defendant,
Benjamine A. Putnam, as Executor as aforesaid, at the sale made of the
lands of the Arredondo grant, in the month of February, one thousand eight
hundred and forty nine, and no sale by said Master shall be held binding
or valid until the same shall have been reported by said Master, to the said
Court or to the Judge thereof, and been confirmed, and whereas, afterward,
at the June Term, one thousand eight hundred and fifty three, of the said
Court, the said Special Master made a report to the said Court, in which,
among other things, he reported the sale at public sale of the premises hereinafter
discribed to the said party of the second part, and whereas there being no excep-
tion to the said report, the same was confirmed by the said Court,and the sale
Master was by order of said Court, among other things, authorized, and
empowered to make execute and deliver conveyances, among others, to the
said party of the second part, for the tract of land purchased by him
from the said Master as afroesaid, whenever, he, the said party of the
second part, shall have complied with and fulfiled his contract of purchase
with the said Special Master, and have paid the whole amount of the
purchase money for the said tract of land, And whereas, the said party
hath this day complied with and fulfilled the said contract and paid the
whole amount of his purchase money therefore NOW THIS INDENTURE
WITNESSETH, that the said Charles A.M. Mitchel, Special Master in
Chancery, as aforesaid, in order to carry into effect the said sale,
the
made in pursurance of^said decrees above cited, and in consideration of
the premises, and of the sum of Four thousand paid at the time
of the execution hereof, by the said party of the second part to the said
Charles A.M. Mitchel Special Master, as aforesaid, the receipt whereof is
hereby acknowledged, hath granted, bargained, sold, released, conveyed
and confirmed, and by these presents doth grant, bargain, sell, release,
and confirm unto the said party of the second part, his heirs, assigns
forever, all that tract of or parcel of land known and discribed on the
map of the Arredondo Grant, in the Survey of David Burr and Henry
Washington, in the year one thousand eight hundred and forty five
as section Number Ten(10) Township No Ten(10) of Range No nineteen(19)
together with all and singular the right, members, privileges, hereditmen
heritaments and appertenances to the same belonging, or in anywise
and singular
appertaining, to have and to hold all of^the said premises above mentioned
and discribed, and hereby granted and conveyed, or intended to be so with
the appurtenances unto the said party of the second part, his heirs and assigns,
to the only proper use, benefit and behoof, of the said party of the second
part, his heirs and assigns forever.
