Know all men by these presents That I John
Houston M. Clinch of the State of Georgia, Sole qualified Executor,
in the State of Florida, of the last will and Testament of the
late Duncan L. Clinch by virtue of the power in me vested by
Said will, in consideration of the Sum of Ten Thousand dollars
to me in hand paid by John L. Youngue of the State of South
Carolina, have granted, bargained, Sold and released, and by these
presents do grant, bargain, Sell and release unto the Said John
L. Youngue and his Heirs and assigns, all that tract or parcel
of land Situate and lying in the State of Florida, near the
center of the body of land in said State known as the Arredondo
Grant, and designated in Burrs plat of said grant of the
date of February the 9th A.D. 1846 as a parrellogram containing
one thousand (1000) acres, the property of D.L. Clinch and
bounded on the North by part of fractional Section Seven (7)
designated on said plat as the land of Israel Foote, and by
fractional Section Eight (8) designated on Said plat as land of
Isaac Frost, on the East by part of fractional Section Eight
Eight (8) designated as before, and by fractional Section Sixteen
(16) on the South by fractional Section Twenty (20), designated
on said plat as land of land John H. Lewis, and by part of
a tract designated on said plat as land of Thomas Napier,
and on the West by a part of fractional Section Seven (7)
designated as land of Israel Foote, all in Township Ten (10) South
and Range Twenty (20) East, of lands subject to sale in St.
said
Augustine in the^State. Together with all and Singular the
rights, Members, Herriditaments and appurtinances to the said prem=
=ises belonging or in any wise incident or appertaining,
To have and to hold all and Singular the premises before
mentioned, unto the said John L. Youngue, his Heirs and
assigns, forever, And Whereas the plat of the Arredondo Grant
by David H. Burr hereinbefore refered to, Shows same conflict as to the
Title to the tract designated on said plat as a Thousand acre tract
belonging to one Thomas Napier, and the Thousand acre tract designated
as belonging to Duncan L. Clinch, Deceased and hereinbefore conveyed by
me as executor aforesaid, for the better Securing the said John
L. Youngue in his title to the whole of the Thousand acre tract
designated by the parrellogram on said plat, I, John Houston
M. Clinch do hereby warrant and defend the portion of said
parrellogram included within the lines of the Thousand acre tract
designated as Thomas Napiers and conflicting with the parrellogram
herein conveyed, according to the plat aforesaid, against the lawful
claims of the said Thomas Napier and his heirs and all and every
other person claiming or to claim through him or them,
And it is by these presents Stipulated and agreed, that the
measure damages in case it is ascertained that the title
of the said Thomas Napier, Shall be found to be better than
that hereinbefore conveyed, Shall be Ten dollars an acre for every
