State of Florida, Alachua, County:
This indenture, made the tenth day of January in the
year of our Lord one thousand Eight hundred and Fifty two and in 77th
year of the Independance of the United States of America, between James T.
Thomas of Alachua County of the one part and Musco Boulware
of the same County of the one part. Witnesseth: That the said James
T. Thomas for and in consideration of the sum of One thousand dollars
in hand paid, at and before the Sealing and delivery of these presents
the receipt whereof is hereby acknowledged, hath granted, bargined,
sold, aliened, conveyed and confirmed and by these presents doth
grant, bargin, sell, alein, convey and confirm unto the said Musco
Boulware his heirs and assigns All that certain tract an parcel
of land situate in the County of Alachua and State afore said being
the East half of Sec. 16, T 10 of the Arrendonda Grant containing
Three hundred and sixty-four acres, being part of the same premises
and lands bid in at the sale of the Arrednoda Grant in Feby., 1849
by Wm Thom Trustee &C &C confirmed to the said William Thom
by decree of the Circuit Court of East Florida on the 11th day of
August 1849 & which said parcel herein above described & herein
intended to be conveyed was afterwards conveyed by said William
Thom to George R. Fairbanks and hath this day been conveyed by
said Fairbanks to said James T. Thomas
To Have and to Hold the said lands with all and
singular the rights, members and appurtenances thereof whatsoever
to the said lands being, belonging or in any wise appertaining
with the remainder and remainders, reversion and reversions, rents,
issues and profits thereof, to the only proper use, benefit and behoof
of the said Musco Boulware his heirs, Executors and administrators
and assigns, in fee simple: and the said James T. Thomas for
himself & heirs Executors, Administrators, do Covenant with
The said Musco Boulware his heirs executors, and administrators
That he is lawfully Seized in fee of the of the afore granted premises:
that they are free from all incumbrances; that he has good
right to sell and convey the same to the said Musco Boulware
as aforesaid; And that he will, and his heirs executors and
administratyors Shall, Warrant and defend the same, and every
part thereof, to the said Musco Boulware his and assigns
forever, against the lawfull demands of all persons, by virtue
of these presents
