This indenture made the twenty fifth day of October
in the year of our Lord one thousand eight hundred
and fifty two, between John H. Thornton of the County
of Alachua and State of Florida of the first part,
and Samuel Baxley of the said County and Stata of the
second part, witnesseth that the said John H. Thornton
for and in consideration of the sum of Sixty two dollars
to him in hand paid by the said Samuel Baxley at
and before the sealing and deliver of these presents
the receipt whereof is hereby acknowledged, hath granted,
bargained, sold, conveyed, aliened, remised, released and
confirmed and by these presents doth grant, bargain, sell,
alien remise, release and confirm unto the said Samuel
Baxley the following described lot of land to wit, Lot
Number thirteen(13) in the North half range of the Four
of Newnansville Alachua County, as per plat of said
Town on file in the office of the Judge of Probate for
said County, with all the appurtenances and all the
claim, interest, right, title and demand of the said John
W. Thornton in and to the said premises, To have and to
hold the same with the appurtenances unto the said Samuel
Baxley his heirs and assigns forever in fee simple.
And the said John W. Thornton for himself and his
heirs doth hereby covenant and agree to and with Samuel
Baxley his hiers and assigns that he is now the owner of
the said premises and is seized of a good indefeaseable
estate of inheritance therein: and that he has full right
and power to sell and convey the same in fee simple abso-
lute: that said premises are free and clear from all
incumberances; that the said Samuel Baxley his heirs
and assigns may forever hereafter have, hold, occupy,
possess and enjoy the same without any suit, molestation
or interuption whatever lawfully claiming any right therein
and that the said John W. Thornton and all persons hereaf-
ter claiming under him will at the request and expense
of the said Samuel Baxley his heirs and assigns make
and execute all such further assurances for the more
effectual conveying of the said premises with the ap-
purtenances as may be reasonally required by the said
Samuel Baxley his heirs and assigns. And the said |
