Kershaw District } Whereas I the undersigned
John Whitaker with my wife Margaret Whitaker
and others did on the eighteenth day of April Eighteen
hundred and fifty five, file our bill in the Court of
equity for the district and State aforesaid, against
Isabella Scota McRa, James Chesnut Whitaker
and others, praying among other things for reciprocal
substitution of certain negro negro slaves respectively
set out in schedules A & B exhibited with said bill
And whereas further such proceedings were had
under said bill, that the Honorable Court of Equity
aforesaid on the fifteenth day of November Eighteen
hundred and fifty five, did order and decree among
other things "that the negro slaves set forth in
"schedule B as the negro slaves of complainant John
"Whitaker be substituted for the negro slaves mentioned
"in Schedule A as derived by Mrs. Margaret Whitaker
"under the will of her father the late Duncan McRa"
"that the said John Whitaker do by proper deed con-
"vey the said negro slaves to John Lawrence Whitaker
"in trust for the use and benefit of Margaret Whitaker
"during the term of her natural life upon the same
"terms, conditions, restrictions and limitations over
"as are mentioned in the will of the late Duncan McRa
"of and concerning the thirty slaves bequeathed to
"his daughters"
Now Know all men by these presents
that I John Whitaker in pursuance of the said order
and in consideration of a substitution of negro slaves
therein ordered to be made to me, have bargained
sold and delivered and by these presents do bargain
sell and deliver unto the said Lawrence Whitaker
the following named negro slaves, being those men-
tioned in Schedule B filed with said bill, viz: --
Flora, Mary, Grace, Beck, Sarah Flora, Flora Molly, Emma
Mack, Bennett, Miles, Simon, Tod, Terra, Hilliard
William & Joe Eighteen in number
To Have and to Hold the said negro slaves with
their future issue and increase unto the said --
Lawrence Whitaker his Exes and admins forever
but upon this special trust and confidence,
that he shall hold the said negro slaves for the
use and benefit of Mrs. Margaret Whitaker, during
the term of her natural life, to her sole and sep-
arate use, without being in any manner subject to
the debts contract or control of her husband, and
from and immediately after the her death of to the heirs of
her body who may be then living, or to the issue
of such heirs then living & according to the terms
conditions, restrictions and limitations mentioned
in the will of the late Duncan McRa of and con-
cerning the thirty slaves bequeathed to his daugh- |
