and fifty five payable, twelve months after date
to Charles Gavin or bearer, Stand held and fir
mly bound unto the said Charles Gavin for the
payment, of the full and Just sum of Seventy three
dollars and twenty cents as in and by the said Se
aled notes and consideration thereof, reference being
Thereunto had, will more fully appear. Now know
all men That I the said Samuel J. Downing in
consideration of the said debt and sum of money
aforesaid and for the better securing the pay-
ment; thereof, to the said Charles Gavin accor-
ding to the condition of the said note and also
in consideration of the further sum of three
dollars to me the said Samuel J. Downing in
hand well and truly paid by the said Charles
Gavin at and before the sealing and delivery
of these presents the receipt whereof is here
by acknowledged I the said Samuel J. Downing
have granted bargained sold and released
and by these presents, do grant bargain &
sell and release unto the said Charles Gavin
a certain plantation or tract of land con-
taining one hundred and thirty five 55/100 acres
135.55 more or less situate being and lying in
Alachua County known and described as follows
to wit, Lots No One two and three of Section
No four in Township No Eight, South of
Range No Eighteen East, Together with
all and singular the rights, members here-
ditaments and appurtenances to the said
premises belonging or in any wise incident
or appertaining To have and to hold all

and^said premises unto the said Charles
Gavin his heirs and assigns forever and
I the said Samuel J. Downing do hereby
bind my self my heirs Executors and admin
istrators to warrant and defend forever all
and singular, the said premises unto the
said Charles Gavin his heirs and assigns
from and against my self my heirs and
Executors administrators and assigns 
Provided Always nevertheless and it is the
true intent and meaning of the parties
to these presents that if the said Samuel
J. Downing do and shall well and truly pay
or cause to be paid unto the said Charles
Gavin his heirs or assigns the said debt or
sum of money aforesaid with the interest
thereon at Eight per cent, per annum ac=
cording to the true intent of these and meaning
of the said note, and condition Then 
this deed of bargain and sale shall cease
determine and be entirely null and void
other wise it shall remain in full force and
