me Lewis F. Robertson a Commissioner of deeds for the
State of Florida residing in said City of Charleston
in the State of South Carolina personally appeared the
within named John H. McI Clinch Executor of
the last will and testament of Duncan L. Clinch decease
and he then and there acknowledged to me that he signed
sealed and delivered the within instrument of writing
as his proper and **** as such Executor, for the pur
poses, therein mentioned and desired the same to be re-
corded, as such. In testimony whereof, I have here
unto set my hand and seal at Charleston the day

This Indenture maid this 10th day of July in the year
of our Lord One Thousand Eight hundred and fifty five
between John H. Malphurs and Elizabeth Malphurs his
wife of the State of Florida and County of Alachua
parties of the first part, and Wiley H. Burnett of
the State of Florida and County of Alachua party
of the second part, Witnesseth that the said parties
of the first part, for and in consideration of the
sum of Three Dollars Lawful money of the United
States of America to them in hand by the said party
of the second part well and truly paid at and before the
