This Indenture made the first day of March one
thousand eight hundred and fifty five Between
Charles W. Brush and Eugene Van Ness surviving
Exectutors of the last will and testament of Nehemiah
Brush late of the City of New York deceased of the first part
and John W. Phifer of Alachua County in the State
of Florida Planter of the second part, Witnesseth that,
the said parties of the first part by virtue an authority
to them given in and by the said last will & testa-
ment and for and in consideration of the sum of Five
hundred and fifty seven 84/100 Dollars ($557 84/100) lawful mon
ey of the United States of America to them in hand pai
d at or before the ensealing or delivery of these presents
by the said party of the second part the Receipt where
of is hereby acknowledged and the said party of the sec-
ond part his heirs Executors administrators forever re
leased and discharged from the same by these presents
have granted bargained sold Aliened released conveyed &
confirmed and by these presents, do grant bargain sell
alien release convey and confirm unto the said party
of the second part, his heirs and assigns forever all that
certain fractional section of Land situate in a
tract of land known as the Arredondo Grant, being
partly in the County of Alachua and partly in the County
of Marion in the State of Florida and which is designated
on Burr & Washingtons map of said Grant as frac=
tional section section number thirty two Thirty one
(31) in Township Number nine (9) In range number
twenty two (22) containing two hundred and fifty seven
84/100 acres of land be the same more or less said fractional
section among other parcels of land in said Grant
having been purchased by the parties of the first part
for the Benefit of the heirs of Nehemiah Brush deceased at
a Sale of said Grant, made for purposes of partition
by order of Court, on the 21th day of February 1847 or there
abouts which sale was duly confirmed at the June term
of the Circuit Court of St. Johns County in said State of Fl=
orida in the same year as will fully appear by referance
to the proceedings on file in the case of Brush et al vs Pr
all et al in the office of the Clerk of the Circuit Court
of Alachua County in said State where also will be
found duly recorded the last will and testament
of the Said Brush deceased, Together with all and |
