This Indenture entered into on this tenth 10 day
November One thousand eight hundred & sixty six 1866
between James M. Richardson of the first part and his
wife Margaret L. Richardson and Dr J.F. McInstry of
the second part, Witnesseth - For and in consideration of
the sum of two thousand three hundred dollars $2300
to us in hand paid the receipt of which is hereby acknow
=ledged we have this day bargained and sold and
by these presents do bargain and sell to the said J.
F. McInstry his heirs executors administrators or assigns
the following tract or parcel of land to wit, Beginning
at the point where Sweet water branch crosses the northern
boundary of the Town of Gainesville thence West along said
boundary to the Section line dividing Sections four and five
township ten range twenty, Thence North along said Section
line to Sweet water branch ~ Thence down the middle of the run
of said branch of "Sweet water" to the point of beginning contain
=ing five and one half acres (5 1/2) more or less - To Have
and to hold to the said J.F. McInstry his heirs, executors
administrators or assigns, together with all the rights or
appurtinances thereunto belonging - And we do covenant
with the said J.F. McInstry, that we are lawfully seized
of the above described tract of land; that we have good
right to sell the same and we do warrant and defend
the said J.F. McInstry his heirs executors administrators or
assigns in the peaceable possession of the same against the
lawful claims of all persons whomsoever.
In witness whereof, we have hereunto put our hands and seals

M. Richardson and Margaret L. Richardson his wife, the signer
of the above instrument of writing, who say that it was executed
for the purposes therein mentioned and in the part of the wife
that is was signed by her without compulsion or the fear of it
on her part - In witness whereof I have hereunto put my
hand and Official seal, this 12th day of November One
thousand eight hundred & sixty six (1866
