his heirs and assigns forever in fee simple and the
said party of the first part shall and will forever warrant
and defend the same and the right and title thereto
unto the said party of the second part his heirs and
assigns from and against him and themselves and
against the claim of all other persons whatever as far as
he can do by his said attorney in fact here by rattifying
and confirming the same.

This Indenture made this fifth day of January AD
1866 between George R. Fairbanks of the State of Tennessee
party of the first part and Philip Dell Executor of B.M.
Dell decd of Alachua County Florida party of the second
part Witnesseth that said party of the first in consid-
eration of the sum of four hundred dollars, hath
quit claimed granted and released and doth quit
claim grant and release to said party of the second
part as Executor as aforesaid all that certain tract
or parcel of land, being the West half of the North
East quarter of section 3 T 8 Range 18 S & E being part
of the grant to George Atkinson in the County of Alachua
To have and to hold the said lands and the appurtenances
to the said party of the second part as sole Executors
and his assigns forever free quit claiming and released
of any from all claims and demands of him the said
party of the first part his heirs Executors and administrators
In witness whereof the said party of the first part hath here-
