This Indenture made this the tenth day of
September AD 1866 between Benjamin Waldo of the County and
State aforesaid of the first part and Saml W. Mays, Trustee
for Mrs Sarah L. Waldo of the second part - Whereas John
Lipscomb died Seized and possessed of Certain real
estate being in the State of Florida leaving the said Cestui que
trust entitled to a distribution interest said estate by his
last Will and Testament, whereof the said first party
is one of the executors and as such accountable for the
proceeds from the Sale of said real estate in settlement of =
said distribution interest And where as it Just and equitable
that the funds owned as aforesaid should ensure and be applied
to the Sole and seperate use of the said Cestui que trust and =
family during her natural life for their maintainance and
at her death to her heirs as tenants in common forever.
And whereas the said party of the first part desires and
intends to secure by these presents the faithful payment
of the indebtedness aforesaid according to the tenor and
effect of a certain promissory note of even date herewith
payable to the said second party as trustees as aforesaid in the
sum of Eighteen thousand Dollars
Therefore this Indenture witnesseth That the said party of
the first part in Consideration of the premises and of the sum
of Five Dollars to him paid by the said party of the second part
the receipt whereof is hereby acknowledged by these presents doth
give grant alien sell convey and confirm unto the said Samuel
W. Mays all and singular the following described lands goods
and Chattles To wit Lot 4 of Sec (25) and lots 1 and 2 of Section
(36) also the SE1/4 of NE1/4 and the NE1/4 of the NE1/4 of
Section (36) also the NW1/4 of the SW1/4 and the NE1/4 of
the SW and the N1/2 of the SE1/4 of Section (35) also lot
3 of Section (36) in Township 15 of Range 21 East
