as follows: on the North by the Town of Gainesville, on the
East by lands of Fredenburg, J.H. Roper, S.P. Bevill, and A.H. Leon
=ard; on the South by lands of Thomas Little and J.H. Roper: on 
the West by lands of J.R. Bevill, C.E. Haile and J.W. Montgom
=ery: also the following lots or parcels of land Situated lying
and being in the State and County aforesaid and Known as
follows to wit lot one (1) in Block four (4) Range three (3) and
Lot one (1) in Block two (2) Range three (3) as laid down in the
map of the town of Gainesville; together with all and sing
ular the tenements, heriditaments and appurtinances
and the Estate, title and interest of the said parties of 
the first part therein, and the said parties of the first
part do hereby covenant and agree with the said party
of the second part, that at the time of the delivery hereof
the said parties of the first part are the lawful owners
of the premises above granted and seized thereof in fee simple
absolute and that they will warrant the above granted
premises in the quiet possession of the said party of the
second part his heirs and assigns forever
   Provided nevertheless that if the said R.M. Roberts
and R.W. Roberts their heirs executors, administrators and
assigns or either of them shall well and truly pay or cause
to be paid unto the said J.H. Roper his heirs and assigns
said promissory notes aforementioned, amounting in all to
Ten thousand dollars on the days and times mentioned
and appointed for the payment thereof in the said promis
=ory notes with lawful interest for the same according to the
tenor of said notes, then and from thence forth as well this
present Indenture and the right to the property therein conveyed
as the said promissory notes shall cease, determine and be
void to all intents and purposes, otherwise to remain in full
force & virtue = and it is further Stipulated and agreed
that upon default of payment of any of said notes, agreeably
to this tenor and effect and at the time specified, that
the said party of the second part shall have the right to
foreclose by proceedings at law or in Equity after the first
day of January Eighteen hundred & Sixty Eight to recover what
is then due and it is also agreed by and between the parties
to the these presents, that the said parties of the first part shall
and will keep the buildings erected and to be erected upon
the land above conveyed insured against loss and damage
by fire by insurance and in an amount approved by the said
party of the second part and assigns the policy and certific
ates thereof to the said party of the second part to effect
such insurance and premium and premiums paid for
effecting the same shall be a lien in the said mortgaged
premises, added to the amount of the said bond or obligation
and secured by these presents, and payable on demand with
