part, all of the County & State aforesaid, whereas the said
J.M. Sparkman, M.H. Sparkman and Stephen Sparkman
hath promised to pay the first of said notes amounting to
Five hundred & Seventy six Dollars, on the first day of January
1869, and the Second note amounting Six hundred & Eighteen
66/100 Dollars on the first day of January 1870 to the said
A.H. Cole administrator aforesaid or to his order, as by the said
recited promissory notes reference being thereto had will
more fully and at large appear - Now this Indenture
Witnesseth that the said J.M. Sparkman and Sinah his
wife as well for and in consideration of the aforesaid debt
or sums of money named in said promissory notes, and for
the better securing the payment thereof unto the said A.H. Cole
administrator or his assigns in discharge of the said
recited promissory notes, as for the further sum of One dollar
to them in hand paid at and before the ensealing and
delivery of these presents the receipt whereof is hereby acknow
=ledged, have granted bargained, sold, released, and confir
=med, and by these presents doth, grant bargain, sell release
and confirm unto the said A.H. Cole administrator all that
certain tract or parcel of land situate lying and being in
the County of Alachua and State of Florida, and known and
distinguished by United States Survey as the South East quarter
of the South West Quarter, the South East Quarter of the South East
Quarter, the South West Quarter of the South West Quarter and
the North East Quarter of the South West Quarter, being in
Section Twenty three, Township Eight South of Range Twenty one
East, containing two hundred acres more or less, together with
all and singular the rights and members, tenements, Heridita
ments and appurtinances to the same belonging or in any
wise appertaining - To Have and to hold the aforesaid barg
=ained premises with all the appurtinances whatsoever thereunto
belonging unto the said A.H. Cole administrator to his own
proper use benefit and behoof forever, Provided always
nevertheless that if the said parties of the first part shall
and do well and truly pay or cause to be paid unto the said
A.H. Cole administrator or his assigns the aforesaid debt or
sum of money according to the tenor and effect of the said
promissory notes then and from thenceforth as well these
presents Indenture and the estate hereby granted, as also the
said recited promissory notes shall cease determine and become
absolutely null and void, to all intents, and purposes, any
thing herein before contained to the contrary in any wise not
withstanding - In Witness whereof the said party of the first
part hath hereunto set their hands and seals this day and
